City or any other site or branch under the control of the First Party inside the Kingdom of Saudi Arabia.

طبيعــــة العقــــــد ( أعـــــزب ) :
Nature of Contract ( Single ):

ساعات العمل :
Working Hours:
1)
ساعات العمل اليومية 8 ساعات وعلى أن لا تقل عن ثمانية وأربعون ساعة إسبوعياً.
1) Daily working hours shall be 8 hours on proviso that weekly working hours shall not be less than forty-eight hours.
2)
يحق للطرف الأول تشغيل الطرف الثاني ساعات عمل إضافية حسب متطلبات العمل بشرط أن لا تزيد ساعات العمل الإضافية عن ساعتين يوميا.
2) The First Party will employ the Second Party overtime hours as per work requirements on proviso that overtime hours shall not exceed two hours daily.
3)
يحق للطرف الأول تقديم أو تأخير ساعات العمل خلال اليوم حسب ظروف ومقتضيات العمل.
3) The First Party may amend commencement and end time of daily work as per work requirements.

نـــــوع التعاقـــــد :
Contract Type:
1)
يعتبر هذا العقد محدد المدة ، وتطبق عليه أحكام المادة ( 37 ) من نظام العمل.
1) This contract is limited period contract and the provisions of Article (37) of Labor Law will apply thereto.
2)
لا يعني تجديد العقد أو امتداده بين الطرفين تحوله إلى عقد غير محدد المدة .
2) Contract renewal or extension shall not mean that it is changed into unlimited period contract.
3)
عند تجديد العقد يجوز تغيير نوع التعاقد بناء على طلب صاحب العمل ، على أن يكون العقد الجديد مبرم لانجاز عمل معين سواء لذات الوظيفة المذكورة أو أداء عمل آخر يطلب من العامل ، وينتهي العقد بانتهاء العمل ما لم يخالف أحد الطرفين أحكام المواد (80 أو 81 ) من نظام العمل.
3) Upon renewal of contract type of contract may be changed pursuant employer’s recommendation, on proviso that the new contract will be made in order to perform certain work for the said job or any other work requested from the worker. This contract will terminate by termination of work unless either party infringes provisions of Articles (80) and (81) of Labor Law.

مــــدة التعاقــــد :
Contract Duration:
1)
مدة هذا العقد سنتــان ، تبدأ من تاريخ مزاولة العامل لمهام وظيفته. ويكون تاريخ المباشرة الموافق : / /
1) The duration of this contract shall be Two years beginning from date of commencement work by the worker . and it will be Starting from : / /
2)
يجـوز تجـديد العقـد بين الطرفين لمدة أخرى أو مدد ممـاثـلة بشـرط المـوافقـة الكتـابيـة على التجديد من الطرفين .
2) This contract will be renewable for other similar period/s dependent on written approval of renewal by both parties.
3)
إذا رغب أحد الطرفين في عدم تجديد العقد فلا يشترط إجراء شكلي لذلك ، ولكن يجب على الطرف الذي لا يرغب في التجديد إخطار الطرف الآخر بذلك قبل نـهاية المدة بـ(30)يوما على الأقل
3) If either party gives an intention of non-renewal, no formal procedure is conditioned for this but, the party that is unwilling to renewal shall give at least 30 days prior notice to the other party.
· مـــدة التجربـــــة :
Probation Period:
-
يخضع العامل لفترة تجربة مدتها تسعون يوما من بدء مزاولة العامل لمهام وظيفته ، ولا تدخل في حساب تلك المدة إجازة عيدي الفطر والأضحى والإجازة المرضية ، ويجوز للطرفين الحق في إنهاء العقد خلال تلك الفترة .
- The worker shall be subject to ninety days probation period from date of commencement work. The holidays of Eid Al-Fitr and Eid Al-Adha and sick leave will not be involved in such probation period. Either party may terminate the contract during such probation period.

تمديد فترة العقد :
Extension of Contract Duration:
1)
يجـوز تمــديد مدة العقـد عند نهايته لفترة أو فترات أخرى ، وبنهاية هـذه الفتــرة ينقضــي العقـد وكافـة الآثـار المترتبة بموجبه .
1) This contract may be extended at expiration for other period/s. By the end of this period the contract will expire and all the effects resulting there from.
2)
عند رغبـة صاحـب العمـل في تمـديد مدة العقد فعليـه أن يخطـر العـامل بـذلـك ويعـيـن فــي الإخـطـار الفتـرة التي يمتـد إليها العقـد .
2) When the employer desires to extend the contract period, he shall give notice to the employee and shall state in the notice the period of extension.
3)
إذا لـم يقبـل العامـل فتـرة تمـديد العقـد بعـد انتهاء مدته فعليـه أن يخـطر صاحب العمل بذلك خلال (15) يوما من وصوله أو علمه بإخطـار التمـديـد ، فـإذا نقـصـت هذه المـدة وهـو يـزاول العمـل يـكـون ذلك مـوافـقـة صـريحـة لقبـوله تـمـديـد العـقـد .
3) If the worker does not accept the extension period after expiration, he shall give the employer 15 days notice prior to his arrival or prior to being aware of the extension notice. If such period decreased while performing work, such decrease will be considered an express approval to extending the contract.

الراتــــــب :
Salary:
1)
يتقاضى الطرف الثاني راتبا شهريا نظير أدائه مهام وظيفته المبينة ووفقا لتعليمات وتوجيهات صاحب العمل ، يصرف في نهاية كل شهر ميلادي موزعاً على الشكل الآتي :-
ـ الراتب الأساسي : ( ...................) ريال .

1) The Second Party shall receive monthly Salary to be paid at the end of each Gregorian month , for performing the tasks of his said job and according to instructions of employer . Distributed as follow :

2)
يبدأ استحقاق الأجر بعد مزاولة العامل للعمل وحصوله على التصاريح اللازمة ، ويتم دفع الأجر شهريا للعامل ، ويعتبر قبض العامل الراتب لكل شهر تصفية لرواتبه السابقة ، وإذا ادعى العامل أنه لم يتقاضى راتبه السابق فعليه عبء إثبات ذلك.
2) The salary shall be entitled to receive salary after commencing work and obtaining the required permits. Salary shall be paid to the worker monthly, and the receipt of the worker to each month’s salary will be considered settlement of his previous salaries. If the worker claims that he has not received some previous salary, he shall endure costs of evidence.

Contractual Benefits:

المواصـــلات :
1) Transportation:

- The First Party shall provide the Second Party with transportation from housing site to work site and vice versa.
2)
الســـــكن :
2) Accommodation:
- [ مؤمـن ] يؤمن له السكن من قبل الطرف الأول.
- The employer shall provide the worker with accommodation.
3)
العناية الصحية والعلاجات : تقوم الشركة بالتأمين الصحي اللازم طبقاً للنظام المعمول به في المملكة العربية السعودية ، ويستثنى من ذلك ما هو مستثنى طبقا لنظام العمل والعمال .
3) Medical Treatment: The company shall provide the worker with medical treatment in compliance to the law applicable in the Kingdom of Saudi Arabia, with the exception of all that is excluded by the Labor Law.

الإجـــــازات :
Vacations:
1)
يستحـق العـامـل عـن كـل عـام إجـازة سنوية مدتها (21) يوما تزاد إلى مدة (30) يوما إذا أمضى العامل في خدمـة صـاحـب العمـل خمس سنوات متواصلة .
1) The worker shall be entitled against each calendar year 21 days vacation that will be increased to 30 days if the worker stayed in the service of the employer for five consecutive years.
2)
لصاحب العمل وحده الحق في تحديد بدء إجازة العامل وفقا لمقتضيات العمل .
2) Employer shall have the sole right of determining the beginning of the worker’s vacation as per work requirements.
3)
يخطر صاحب العمل العامل بإجازته قبلها بمدة (30) يوما ، ولا يجوز للعامل الامتناع عن القيام بالإجازة لأي سبب من الأسباب .
3) Employer shall give the worker thirty (30) days notice of his vacation, and the worker shall have nor right of refusing enjoying the vacation for whatever reason.
4)
يبدأ سريــان مدة الإجازة من اليوم المعين بإخطار العامل بإجازته .
4) commencement of vacation shall be effective from the date determined for the worker to enjoy his vacation.
5)
يباشر العامل العمل فور انتهاء إجازته ، ويخصم من أجر العامل أجر يوم كامل عن كل يوم تأخير لمباشرته للعمل فور انتهاء الإجازة ما لم يكن هناك مبرر مقبول ومؤيد بالمستندات وذلك كله مع عدم الإخلال بحق صاحب العمل بفصل العامل بسبب الغياب .
5) The worker shall report to work as soon as his vacation expires, and each delay day will be deducted from the workers salary unless there will be justifiable cause and supporting documents without prejudice to employer’s right of terminating the worker due to absence.

التزامات العامـــل :
Worker’s Obligations:
-
يلتزم العامل ـ على سبيل المثال لا الحصر ـ بما يلي :
The worker’s obligations shall include but not limited to the following :
1)
يقر العامل ويلتزم بأن كل ما جاء بهذا العقد من التزامات على عاتقه بالإضافة إلى التعليمات والتوجيهات الصادرة من صاحب العمل أو من يمثله هي التزامات جوهرية ، لا يجوز له مخالفتها بأي حال من الأحوال .
1) Worker shall be committed to all provisions of this contract in addition to instructions and orders issued by employer or his representative, and shall not violate such orders at all events.
2)
الالتزام بتعليمات السلامة والأمن والمعمول بها داخل المنشأة .
2) To comply with safety and security instructions that are applicable inside the establishment.
3)
حسن المعاملة مع صاحب العمل ورؤساؤه بالعمل وكذلك زملائه وعملاء صاحب العمل .
3) To behave and show good conduct with employer and his bosses and peers and clients.
4)
الالتزام بالآداب العامة والنظام العام بالمملكة وأن يلتزم بالأنظمة الصادرة والمعمول بها .
4) To respect accepted standards of behavior and general regulation applicable in the Kingdom .
5)
المحافظة على كل ما يعهد إليه من ملابس والآلات ومعدات وأي عهد أخرى يعهد بها إليه صاحب العمل وأن يردها متى طلب منه صاحب العمل ذلك أو عند انتهاء خدمته لأي سبب من الأسباب .
5) To maintain all advances he receive including uniform, machinery, equipment and any other advances given by the employer to him, and he shall return the same when the employer requests so or upon termination of his service for whatsoever reasons.
6)
إذا انتهت مدة العقد وكانت هناك معاملات معلقة أو أي التزامات أخرى في ذمة العامل فعليه أن ينهيها ، ولصاحب العمل عدم إخلاء طرفه أو تصفية حقوقه أو أجوره المتأخرة إلا بعد الانتهاء من ذلك ، ولا يعتبر العقد مجددا في هذه الحالة وإنما ممتدا فقط إلى حين تصفية التزامات وحقوق العامل المتبقية بعد انتهاء مدة العقد .
6) If this contract expires and there are some pending files or other obligations or advances in his custody, he shall finalize the same. The employer shall not release him or settle his due rights or payments except after finalizing, and the contract shall not be considered renewed in this case but extended only until settlement of worker’s obligations and rights pending after expiration of the contract.
7)
أي التزامات مفروضة بموجب نظام العمل السعودي .
7) Any other obligations imposed by Saudi Labor Regulation.
8)
أي التزامات أخرى مرتبطة بوظيفة العامل وما يصدر بخصوص تنفيذها من تعليمات وتوجيهات .
8) Any other obligations related to worker’s job and all that may be issued in relation to implementation of orders and instructions.

مكافأة نهاية الخدمة:
End of Service Benefits:

يتم احتساب مكافأة نهاية الخدمة طبقاً لنظام العمل الصادر بالمرسوم الملكي الكريم رقم ( م / 51 ) وتاريخ 23/08/1426 هـ.
- End of service benefits shall be computed according to Saudi Labor Regulation issued by the Royal Decree No. M/51 dated 23/08/1426H.

تحرر هذا العقد من نسختين أصليتين موقعة من الطرفين دون كشط أو تغيير أو إضافة معتمدة من الطرفين وسلمت كل طرف نسخة للعمل بموجبها عند اللزوم .

3) Employer shall give the worker thirty (30) days notice of his vacation, and the worker shall have nor right of refusing enjoying the vacation for whatever reason.

يبدأ سريــان مدة الإجازة من اليوم المعين بإخطار العامل بإجازته .
4) commencement of vacation shall be effective from the date determined for the worker to enjoy his vacation.
5)
يباشر العامل العمل فور انتهاء إجازته ، ويخصم من أجر العامل أجر يوم كامل عن كل يوم تأخير لمباشرته للعمل فور انتهاء الإجازة ما لم يكن هناك مبرر مقبول ومؤيد بالمستندات وذلك كله مع عدم الإخلال بحق صاحب العمل بفصل العامل بسبب الغياب .
5) The worker shall report to work as soon as his vacation expires, and each delay day will be deducted from the workers salary unless there will be justifiable cause and supporting documents without prejudice to employer’s right of terminating the worker due to absence.

التزامات العامـــل :
Worker’s Obligations:

يلتزم العامل ـ على سبيل المثال لا الحصر ـ بما يلي :
The worker’s obligations shall include but not limited to the following :
1)
يقر العامل ويلتزم بأن كل ما جاء بهذا العقد من التزامات على عاتقه بالإضافة إلى التعليمات والتوجيهات الصادرة من صاحب العمل أو من يمثله هي التزامات جوهرية ، لا يجوز له مخالفتها بأي حال من الأحوال .
1) Worker shall be committed to all provisions of this contract in addition to instructions and orders issued by employer or his representative, and shall not violate such orders at all events.
2)
الالتزام بتعليمات السلامة والأمن والمعمول بها داخل المنشأة .
2) To comply with safety and security instructions that are applicable inside the establishment.
3)
حسن المعاملة مع صاحب العمل ورؤساؤه بالعمل وكذلك زملائه وعملاء صاحب العمل .
3) To behave and show good conduct with employer and his bosses and peers and clients.
4)
الالتزام بالآداب العامة والنظام العام بالمملكة وأن يلتزم بالأنظمة الصادرة والمعمول بها .
4) To respect accepted standards of behavior and general regulation applicable in the Kingdom .
5)
المحافظة على كل ما يعهد إليه من ملابس والآلات ومعدات وأي عهد أخرى يعهد بها إليه صاحب العمل وأن يردها متى طلب منه صاحب العمل ذلك أو عند انتهاء خدمته لأي سبب من الأسباب .
5) To maintain all advances he receive including uniform, machinery, equipment and any other advances given by the employer to him, and he shall return the same when the employer requests so or upon termination of his service for whatsoever reasons.
6)
إذا انتهت مدة العقد وكانت هناك معاملات معلقة أو أي التزامات أخرى في ذمة العامل فعليه أن ينهيها ، ولصاحب العمل عدم إخلاء طرفه أو تصفية حقوقه أو أجوره المتأخرة إلا بعد الانتهاء من ذلك ، ولا يعتبر العقد مجددا في هذه الحالة وإنما ممتدا فقط إلى حين تصفية التزامات وحقوق العامل المتبقية بعد انتهاء مدة العقد .
6) If this contract expires and there are some pending files or other obligations or advances in his custody, he shall finalize the same. The employer shall not release him or settle his due rights or payments except after finalizing, and the contract shall not be considered renewed in this case but extended only until settlement of worker’s obligations and rights pending after expiration of the contract.
7)
أي التزامات مفروضة بموجب نظام العمل السعودي .
7) Any other obligations imposed by Saudi Labor Regulation.
8)
أي التزامات أخرى مرتبطة بوظيفة العامل وما يصدر بخصوص تنفيذها من تعليمات وتوجيهات .
8) Any other obligations related to worker’s job and all that may be issued in relation to implementation of orders and instructions.

مكافأة نهاية الخدمة:
End of Service Benefits:

يتم احتساب مكافأة نهاية الخدمة طبقاً لنظام العمل الصادر بالمرسوم الملكي الكريم رقم ( م / 51 ) وتاريخ 23/08/1426 هـ.
- End of service benefits shall be computed according to Saudi Labor Regulation issued by the Royal Decree No. M/51 dated 23/08/1426H.

تحرر هذا العقد من نسختين أصليتين موقعة من الطرفين دون كشط أو تغيير أو إضافة معتمدة من الطرفين وسلمت كل طرف نسخة للعمل بموجبها عند اللزوم .
